Any order implies full and unconditional acceptance of these GTC, which the Client acknowledges having read before validating their order. The Company may modify the GTC at any time; the applicable GTC are those in effect at the time of order validation.
Article 2 – Products and visuals
The Company offers personalised items as well as non-personalised items. The essential characteristics of each product are presented on its sheet.
The images and visuals presented on the Site are for purely indicative purposes. The final rendering of the product may differ from these visuals due to, in particular, the technical specifications of manufacturing, materials, printing or engraving processes, screen settings, the quality of the files transmitted and the artisanal nature of certain productions. These differences do not constitute a defect of the product.
Article 3 – Price
Prices are indicated in euros (€), all taxes included (VAT included, where applicable), excluding delivery charges.
The Company reserves the right to change its prices at any time. The applicable price is that displayed on the Site at the time of order confirmation.
Article 4 – Delivery charges, taxes and customs
Delivery charges are the responsibility of the Customer and are clearly indicated before the final confirmation of the order.
Taxes and customs. For deliveries outside of the European Union, customs duties, taxes or additional charges may be applied by the destination country. These charges are entirely the responsibility of the Customer, who must inquire in advance with the authorities of their country. Refusal or non-collection of a parcel for this reason does not entitle to any refund.
Article 5 – Order
1. The Customer selects their products, provides any customisation details, checks the summary of their order (products, customisation, total price, delivery charges) and then confirms it by clicking on the “ Pay Now ” button.
2. The confirmation of the order constitutes the conclusion of the contract. A confirmation email is sent to the Customer.
3. The Company may refuse or cancel a order in the event of an existing dispute with the Client, suspicion of fraud, unavailability of the product, illicit customisation content or contrary to public morals, or a manifest error in price display. The Client will then be fully refunded.
Article 6 – Customisation: Client's responsibility
The Client is solely responsible for the information provided for the personalisation of their product (texts, names, dates, photos, visuals, colour choices, sizes, etc.).
The Company cannot be held responsible for any error made by the Client (spelling mistakes, incorrect photo, low-resolution photo, incorrect size, wrong colour choice, etc.).
It is the Client's responsibility to carefully check all the information entered before finalising their order. Once the order is validated, production is initiated and no modifications can be guaranteed.
The Company may refuse any personalisation that it deems unlawful, defamatory, hateful, contrary to public morals or infringing the rights of third parties.
Article 7 – Content provided by the Client (intellectual property)
By submitting photos, texts, logos or other visuals for the personalisation of their products, the Client guarantees that they hold all the rights necessary for these elements (copyright, right to image, trademark rights, rights of the represented persons, etc.) and that they are authorised to have them reproduced. The Client releases the Company from any liability in the event of a dispute, claim or action by a third party related to intellectual property rights or any other rights concerning these elements, and agrees to indemnify it against any condemnation, costs and damages resulting therefrom (including reasonable legal fees).
The Company has no obligation to control, verify or validate the content transmitted by the Client, nor to verify its legality or the related rights. The Company may, at its sole discretion and without being obliged to do so, refuse or cancel, without compensation, any order whose content it considers to infringe the rights of third parties or to be illegal. The absence of refusal, objection or control by the Company shall in no case constitute validation of the content, waiver of its rights, or acceptance of liability, and does not relieve the Client of its guarantees and obligations set forth in this article.
The Client grants the Company, for the sole purpose of executing the order, a non-exclusive licence to reproduce and adapt this content.
Article 8 – Payment
The price is payable in full at the time of the order, by the payment methods offered on the Site: Bank transfer, Bancontact or PayPal. Payments are processed by a secure payment provider; the Company does not have access to the complete data of the Client's credit card. The order is only processed after receipt of payment.
Article 9 – Delivery
1. The products are delivered to the address provided by the Client at the time of the order. It is the Client's responsibility to ensure the accuracy of this address.
2. The indicated timeframes consist of a manufacturing period (customised products being made to order) of 3 working days and a delivery time that varies according to the chosen delivery method. They are given as an indication.
3. The Company shall not be held responsible for delays attributable to the carrier, exceptional weather conditions, strikes or any other event of force majeure. These warranties apply independently of any other commercial warranty and do not cover normal wear and tear, or damage resulting from improper use or inadequate maintenance, nor differences falling under Article 2 (indicative visuals), nor errors in personalisation attributable to the Client. To implement it, the Client contacts the Company at https://www.crea-nova.be/contactus in a reasonable time after the defect is discovered.
